Liability Waiver & Release Agreement
The Audience Company & Arrivals Club
By signing this form, I acknowledge and agree to the following terms as a participant in the [Tour/Conference Name] organized by Graetz Media Group and Arrivals Club (including their officers, directors, employees, agents, and partners) (“Organizers”):
1. Voluntary Participation & Assumption of Risk
I confirm that my participation is voluntary and that I understand the tour includes international travel, conferences, and station visits across multiple countries, involving flights, trains, road transport, and walking. I acknowledge that these activities carry risks, including but not limited to: illness, injury, accidents, property loss or damage, delays, and disruptions. I knowingly and freely assume all such risks.
2. Release of Liability
While the Organizers will take reasonable steps to promote my safety and comfort, I waive, release, and discharge the Organizers from any and all liability, claims, demands, or actions arising out of or related to my participation, whether caused by negligence or otherwise.
3. Indemnification
I agree to indemnify and hold harmless the Organizers from any claims, damages, or expenses (including legal fees) brought by third parties in connection with my actions, conduct, or participation in the tour.
4. Medical Responsibility & Insurance
I am solely responsible for any medical needs, treatment, or expenses I may incur during the tour. I have been strongly encouraged to purchase comprehensive travel and health insurance to cover such risks.
5. Third-Party Providers
I acknowledge that airlines, hotels, venues, transport companies, and other service providers are independent contractors and not agents of the Organizers. The Organizers are not liable for their acts, errors, or omissions.
6. Force Majeure
I understand that the Organizers are not responsible for cancellations, delays, or changes to the itinerary caused by events beyond their reasonable control, including but not limited to weather, strikes, natural disasters, government actions, or public health emergencies.
7. Media Release
I consent to photographs and video taken during the tour being used for promotional and informational purposes by the Organizers unless I notify them in writing before the tour that I do not wish to be included.
8. Severability & Binding Effect
If any portion of this agreement is found unenforceable, the remaining terms remain valid and enforceable. This agreement is binding on me as well as my heirs, executors, administrators, and assigns.
9. Governing Law
This agreement will be governed by and interpreted under the laws of the State of Tennessee, USA.
10. Acknowledgment
I have read this waiver, understand its contents, and sign it voluntarily. I understand that by signing, I am giving up certain legal rights, including the right to sue the Organizers for claims relating to the risks described above.
