Liability Waiver & Release Agreement Graetz Media Group LLC & Arrivals Club LLC
By signing this form, I acknowledge and agree to the following terms as a participant in Handcrafted Experiences, Radiodays 2026 organized by Graetz Media Group LLC and Arrivals Club LLC (including their officers, directors, employees, agents, and partners) (“Organizers”):
1) Voluntary Participation & Assumption of Risk I confirm that my participation is voluntary and that I understand the tour includes international travel, conferences, and station visits across multiple countries, involving flights, trains, road transport, and walking. I acknowledge these activities carry risks including illness, injury, accidents, property loss or damage, delays, disruptions, and events beyond the Organizers’ control. I knowingly and freely assume all such risks.
2) Release of Liability While the Organizers will take reasonable steps to promote my safety and comfort, I waive, release, and discharge the Organizers from any and all liability, claims, demands, or actions arising out of or related to my participation, whether caused by negligence or otherwise, to the maximum extent permitted by law.
3) Indemnification I agree to indemnify and hold harmless the Organizers from any claims, damages, or expenses (including legal fees) brought by third parties in connection with my actions, conduct, or participation in the tour.
4) Health, Fitness & Medical Responsibility I warrant that I am fit to participate and have disclosed any relevant medical conditions. I am solely responsible for any medical needs, treatment, or expenses I may incur during the tour. Comprehensive travel and health insurance is strongly recommended. In a medical emergency, I authorize the Organizers to take actions they deem in good faith necessary for my health and safety; I accept financial responsibility for related costs.
5) Travel Documents & Compliance I am responsible for meeting all entry, visa, vaccination, and passport requirements for all countries visited, including passport validity. I will comply with local laws and all reasonable instructions from the Organizers and host partners.
6) Third‑Party Suppliers I acknowledge that airlines, hotels, venues, transport companies, and other service providers are independent contractors and not employees of the Organizers. The Organizers are not liable for their acts, errors, or omissions.
7) Independent Contractors; Agency Role I understand and agree that:
The Organizers act solely as organizers and, where applicable, as the participant’s disclosed agent to facilitate bookings with independent third‑party suppliers (including airlines, hotels, venues, transport companies, and ticketing providers).
Those suppliers are independent contractors and are not employees, partners, joint venturers, or agents of the Organizers, and the Organizers do not control their operations or performance.
The Organizers are not a carrier or the provider of hotel, air, ground, or event services and make no representation or warranty regarding the acts, omissions, or performance of any third‑party supplier. To the fullest extent permitted by law, the Organizers shall not be liable for any act, error, or omission of such third parties.
8) Confidentiality & Non‑Recording Private station sessions and invitations are conducted under a discretion policy (Chatham House Rule). I agree not to record audio/video or publicly attribute remarks without express permission from the Organizers and hosts.
9) Itinerary Changes & Cancellations by Organizers
Minor changes: The Organizers may make minor changes that do not materially affect the overall quality of the tour without advance notice or compensation.
Major changes: If material elements (e.g., destination, accommodation standard, or key itinerary components) change, the Organizers will notify me as soon as practicable
Force majeure: Where changes or cancellations arise from events beyond the Organizers’ reasonable control (see Clause 10), no compensation is payable and any refund will be limited to amounts recovered from suppliers, if any.
Participants should purchase Travel Insurance to cover such cancellation events
10) Force Majeure The Organizers are not responsible for cancellations, delays, or itinerary changes caused by events beyond their reasonable control, including but not limited to weather, strikes, natural disasters, acts of government, public health emergencies, war/terrorism, or major transport disruptions. In such cases, the Organizers have no obligation to refund amounts that are not recovered from third‑party suppliers.
11) Participant Conduct & Removal I will behave respectfully and comply with local laws and host/venue rules. The Organizers may remove any participant whose behavior poses a safety risk or materially disrupts the group experience. If removed, I am responsible for all costs of early departure, alternative arrangements, and return travel.
12) Payments, Non‑Recoverable Costs & Cancellation Policy I understand that payments are due per the terms provided at booking. Failure to pay when due permits the Organizers to cancel my booking per the Cancellation Policy. Any refunds (including where offered under Clause 9) are net of non‑recoverable supplier fees. The Cancellation Policy is:
Until January 15, 2026: 20% cancellation fee of the total cost; any refundable balance, if applicable, will be returned.
From January 16, 2026 onward: 100% cancellation fee (no refunds).
13) Booking Transfers I may request to transfer my booking to another eligible person by January 15, 2026, subject to Organizer approval, a USD $100 administration fee, and any additional third‑party fees. The transferee must meet all participation requirements and accept these terms. The Organizers may decline any transfer at their discretion.
14) Media Release (Opt‑Out Available) I consent to photographs and video taken during the tour being used for promotional and informational purposes by the Organizers unless I notify them in writing at least 7 days before departure that I do not wish to be included. The Organizers will make reasonable efforts to honor opt‑out requests.
15) No Reliance; Illustrative Itineraries I acknowledge that any descriptions, sample itineraries, or statements about the tour are illustrative and subject to change. I am not relying on any representation not expressly set out in this Agreement or official written materials provided by the Organizers.
16) Limitation of Liability To the maximum extent permitted by law, the aggregate liability of the Organizers for any claim arising out of or related to my participation shall not exceed the amount I paid to the Organizers for the tour. The Organizers are not liable for indirect, incidental, special, punitive, or consequential damages.
17) Severability & Binding Effect If any portion of this agreement is found unenforceable, the remaining terms remain valid and enforceable. This agreement is binding on me and my heirs, executors, administrators, and assigns.
18) Governing Law, Venue & Dispute Resolution This agreement is governed by and interpreted under the laws of the State of Tennessee, USA. The exclusive venue for any dispute is the state or federal courts located in Williamson County, Tennessee. To the extent permitted by law, I waive the right to a jury trial and to participate in a class action.
19) Acknowledgment I have read this waiver, understand its contents, and sign it voluntarily. I understand that by signing, I am giving up certain legal rights, including the right to sue the Organizers for claims relating to the risks described above. I affirm that I am at least 18 years of age and legally competent to agree to these terms.
